Blame Congress, Not The Judges June 13, 2008

Yesterday’s stupid decision to give Gitmo detainees Habeus Corpus is really the fault of Congress and President Bush. Why do I say that? The fact remains that terrorists do exist in a legal grey area. They’re non-uniformed combatants, captured in battle. They shouldn’t have the rights of civilians, with right to trial by a jury of peers and all that – they’re captured in battle and can’t be read their Miranda rights and all of that, and yet they can’t completely have the rights of prisoners of war, because they aren’t official soldiers of any nation. The reason yesterday’s decision happened was because Congress hasn’t done a good enough job outlining what rights terrorists should have.
As Newt Gingrich once suggested, probably what should be done is to write up another Geneva convention that specifically deals with the treatment of terrorists.
